Disabilty Pension: The Hidden Truth.

Cabinet has given a decision to retain the old system of calculation on percentage basis, that is, 30% of pay shall remain the disability element for 100% disability. 

A protection clause needs to be introduced for pre-2016 retirees JCO/NCO/ORs) who stood to gain from the slab rates.

Govt. is denying the reduction in disability pensions of the soldiers.
What is the truth?

The 100% disabled soldiers especially of higher ranks/longer service have been hit hard by the new formula.
They will get substantially lower disability pension than their civilian counterparts i.e. peons, constables, police inspectors, sweepers, IAS officers, police officers etc.

However the loss for the defence personnel with lower levels of disability will be lesser. In few cases defence personnel may get marginally higher disability pension than their civilian friends also.

To correct this anomaly, the defence personnel should be given the disability pension as per the following formula:-


ORs/NCOs:                           Rs 12000 or 30 % of LPD whichever is higher
JCOs:                                    Rs 17000 or 30 % of LPD whichever is higher
Commissioned Officer:          Rs 27000 or 30 % of LPD whichever is higher

  1. Political parties celebrating and taking credit of Surgical Strike across the LOC risking their life and a commando got injured while returning after the mission.
    Probably the disability due to injury to the soldier cannot confined TV room of AC rooms in south block or north Block .
    By placing disability pension below that of a peon is deplorable.

    The error

    The 7th CPC however, made some unsubstantiated remarks about an increase of disability pensions in case of officers as compared to lower ranks and recommended a reversion back to the slab system ostensibly since it would be beneficial to lower ranks. The remarks of the 7th CPC were baseless since the incidence of incurring any disease or disability in service is naturally more in case of officers. While jawans start retiring in their 30s, officers retire in 50s thereby having a much longer span of service and giving rise to a higher chance of incurring a disability. Moreover, lifestyle diseases affected by stress and strain of military service are usually incurred in 40s and 50s and hence it is quite natural for officers to suffer more disabilities statistically.


    Notwithstanding the same, the data used by the 7th CPC was exaggerated and not even authenticated from the Defence Services. It was provided by the Defence Accounts Department in a one-way manner and used at the back of the defence establishment without seeking comments or rebuttal. The slab system was never sought by any of the defence services or even by the MoD. It was a suo motorecommendation which came as a surprise to all stakeholders. No such data was sought in respect of Central Armed Police Forces by the 7th CPC.

    All over the world, stress and strain of military service is universally recognized as having deleterious effects on the health of personnel due to regimented lifestyle, lack of community living, inability to cope up with domestic commitments and deployment away from families leading to aggravation of even common medical conditions. It is well known that defence personnel and veterans in India are dying much younger than civilian counterparts. This fact alone should have actually led to more sensitivity on part of the 7th CPC. However, it twisted the entire issue unethically. The 7th CPC has therefore recommended the reintroduction of an anomaly that was removed by the 6th CPC.

    Where things stand today

    Briefly, in layperson terms, disability element was essentially calculated at the rate of 30 per cent of pay for 100 per cent disability for both defence personnel and civilian employees. For lesser percentage of disability, the amount was proportionately reduced. Similarly, War Injury Element in operational disabilities was calculated at the rate of 60 per cent of pay for 100 per cent disability for both defence personnel and civilians (War Injury Element is known as ‘Disability Element Category E’ in case of civilians). The Government has made no change for War Injury Element for defence personnel or civilians and it shall continue to be calculated as before (60 per cent of emoluments for 100 per cent disability), however the disability element has been drastically reduced for defence personnel and has been notified on three fixed slabs for Officers, Junior Commissioned Officers and Other Ranks while civilians continue to remain on the percentage system.

    The controversy is hence restricted to disability pension and not war injury pension

    Let us say that a civilian and defence employee of same rank/grade get injured together while on official (non-operational) duty and suffer an amputation leading to 50% disability, the following shall be their entitlement for randomly picked ranks at various stages of service:

    Sepoy at the 1st stage (beginning of scale): 6000

    Constable at the beginning of scale: 4510

    Sepoy at the 24th stage (last stage of scale): 6000

    Constable at the 24th stage: 6465

    Naik at 24th Stage: 6000

    Head Constable at 24th Stage: 7560

    Subedar at 12th Stage: 8500

    Inspector at 12th Stage: 9330

    Colonel at beginning of scale: 13,500

    Director Govt of India at beginning of scale: 17,775

    Colonel at 19th Stage (last stage of scale): 13,500

    Director Govt of India at 19th Stage: 30,270

    Lt Gen in the Apex Grade (the highest scale possible): 13,500

    Director General of a Central Armed Police Force: 33,750

    While the slab based system may be beneficial at the lower ranks with lesser length of service, the gap would consistently increase with increase in rank and service. The 6th CPC had put in place a perfect system of protection of disability pension at lower ranks for both civilians and defence personnel based on a fixed slab below which the disability benefits could not fall and wherein the disability benefits regime was equitable for civilians as well as defence personnel at all ranks and levels.

    While this issue needs to be resolved at the earliest, it would be advisable to point out real facts and correct figures rather than emotional appeals based on wrong suppositions. The statements of the 7th Central Pay Commission on disabled personnel were one-sided, baseless and without any valid foundation and should have not been acted upon by the Government. It is also strange that the 7th CPC chose to comment only on disabled personnel of the defence services with one-sided statistics and not on disabled pensioners of other services who are also in absolutely the same boat and are similarly placed.

      DP is given only AFTER retirement, calculated on the last pay drawn.( in 7CPC regime,based on pay in the Matrix ).

      A person at the time of retirement will be, at least, at the highest time-scale rank with highest corresponding pay in the Matrix for that rank.There will be hardly anyone with lower rank with lesser service.

      Almost all OR will retire at min Nk/Hav level with pay of 44-50000 in the Matrix.DP at 30% will be 13200 to 15000.

      A JCOs retiring pay at max service will be 70-90000 with DP of 21000-27000.

      Similarly ALL offrs will retire as Lt Col and above with pay range 150000-220000. DP above 45000

      In all a/m cases %age based DP is beneficial.

      Not beneficial cases are likely to be- presently retired OR below Nk rank,presently retired offrs below Maj. Some Retiring Hon Lts. For All
      these cat of pers a protection clause as at present is required.

      Also if & when a portion of DA ( 50 % etc) is merged with pay there would be corresponding substantial increase in DP in %ge based sys & NO increase if Fixed based.

      If the Fixed system was beneficial the Civ/Police would have fought tooth & nail to get it,which thy have not!!!

      The statements made by MOD on the issue are to confuse the affected pers & mislead all other. Babus are very clever & expert in misleading.Initially even the APCC were misled on the issue.

      Rather than take the MOD side ,we must fight to get at least parity with the Civ/CPOs in DP

  5. this is being unknowingly throuh ruling party in central govt. there are our repersentive like gen.V.K singh &Maj harvardhan singh rathore both are ministers but they dont convey the deficulties of soldiers .it is very same to our community. they are large spooner of the govt.

    The Defence Ministry on Saturday ordered implementation of the 7th Pay Commission’s recommendations on pensions but added the disability pension component will be paid as per the old system until the pay panel’s Anomaly Committee comes out with a solution.

    A ministry order, issued on the eve of Diwali, announced implementation of revised pension under 7th Pay Commission for pre-2016 defence force pensioners, said an official statement. It also said the issue of disability pensions — which is presently on percentage basis but the panel has recommended making it slab based — has been submitted to the Anomaly Committee, and, for now, the old system will continue.

    “The implementation of 7th CPC recommendation relating to methodology for calculation of disability element has been referred to the Anomaly Committee,” the statement said. “The disability element which was being paid to pre-2016 Defence Forces Pensioners as on December 31, 2015 will continue to be paid pending decision on the recommendations of the Anomaly Committee,” it said.

    As per the order, for those who started getting pensions before January 1, 2016, revised pension will be calculated by multiplying by 2.57 the old pension drawn in December 2015. A soldier getting disability pension as a percentage of his salary will get a fixed slab-based amount if the pay panel’s recommendation implemented. — IANS

  9. Over OROP suicide of Subedar Ram Kishan Grewal many questions remained unanswered.

    Proper inquiry be conducted to know the motive of suicide , if it is true that the family demanded handsome compensation and government job for his son before his last rites

    Suicide note needs to be got verified and it be ensured whether he consumed the poisonous thing himself or he was given the poison by someone else.

    Having handsome pension he could wait for getting dues if any instead of taking such a step which has become a political issue of opposition parties also.

    I agree with Gen VK Singh's plea also which is also a part of inquiry even under normal circumstances.
